For months, 29 October 2026 was a date to prepare for. As of today it is simply the law. Three separate rules under the Tobacco and Vapes Act 2026 took effect yesterday, and the practical difference is no longer theoretical: shoppers are being asked for ID for products that never used to require it, and retailers who get it wrong are now dealing with real fixed penalty notices rather than a future warning.
We covered the countdown to this date in detail in our piece on the three rules and the fines, published two days before they took effect, and looked specifically at the nicotine pouch and nicotine free vape side of the change in this earlier article. This piece picks up from the day after: what the rules actually look like now they are in force, how the penalties really work nation by nation, and what official reaction on the day tells us about what is likely to come next.
What actually changed yesterday
From 29 October 2026, the legal age of sale of 18 now applies to every vape and nicotine product sold in the UK, not only the nicotine containing ones. Nicotine pouches, nicotine strips, nicotine pearls and nicotine free vapes, none of which carried a legal minimum age in England, Wales or Northern Ireland before this date, are now treated the same way as any other regulated nicotine product.
- Age of sale: every vape, e-liquid, pod, pouch and strip sold in the UK now carries an 18 and over rule, both in store and online.
- Proxy purchasing: buying any of these products on behalf of someone under 18 is now its own offence, whatever the age of the person doing the buying.
- Promotions: giving products away to promote them, or selling at a nominal price such as 10 pence to achieve the same effect, is banned. Ordinary discounting is not.
- Vending machines: machines that dispense vapes or nicotine pouches are no longer permitted anywhere in the UK, with one narrow exception for adult inpatient mental health settings in England and Wales.
Scotland already had a vape specific age verification framework before this date, so much of what changed there is an extension of an existing system to cover nicotine pouches and other nicotine products for the first time. In England, Wales and Northern Ireland, the age of sale and proxy purchasing rules for nicotine free vapes and pouches are genuinely new offences rather than extensions of something that already existed.
How enforcement really works now
A law changing on paper is one thing. What matters now is how it is enforced. Trading standards teams in England, Wales and Scotland, and local councils in Northern Ireland, can issue a fixed penalty notice as an alternative to prosecution, and the figures differ more by nation than most coverage this week suggested.
What a fixed penalty notice now actually costs
These are the figures that apply from 29 October 2026 to under 18 sales, proxy purchasing, and free distribution or substantial discount offences. Our own age verification policy and the wider guidance we follow on underage sales are built around staying well clear of all three.
| Nation | Fixed penalty | Early payment | If it happens again |
|---|---|---|---|
| England and Wales | 200 pounds | Reduced to 100 pounds if paid within 14 days | Three offences in two years can bring a restricted sale or premises order lasting up to 12 months |
| Scotland | 200 pounds | Reduced to 150 pounds for prompt payment | Each earlier enforcement action or conviction in the previous two years adds 200 pounds to the penalty, and three offences in two years can bring a banning order of up to two years |
| Northern Ireland | Up to 250 pounds for retail sale offences, up to 500 pounds for registration offences | Around a quarter lower for prompt payment | Three offences in five years can bring a restricted order of between 28 days and three years, subject to Assembly approval of the exact figures |
Refusing to pay does not end the matter. The authority can still prosecute, and a court can impose a much higher fine, including a custodial sentence of up to 12 months on summary conviction or 2 years on indictment in England and Wales for the most serious free distribution or discount offences.
Nicotine Pouches By Hayati
Nicotine pouches are one of the categories most directly affected by the 29 October change, moving from an unregulated age status to the same 18 and over rule as the rest of our nicotine range. Hayati's tobacco free pouches come in a range of strengths and flavours, and every order is subject to the same age checks as the rest of our range at checkout.
Shop NowOfficial reaction on the first day
The change was accompanied by some of the strongest public health language used around vaping policy so far. Health minister Dame Diana Johnson called the Act the greatest piece of public health legislation in a generation, while England's Chief Medical Officer, Professor Chris Whitty, said that addicting children to nicotine is completely unacceptable.
John Herriman of the Chartered Trading Standards Institute welcomed the closing of loopholes, noting that officers previously had very little they could do when a worried parent raised concerns about a child buying a nicotine pouch or a flavoured, nicotine free vape. Andrew McCracken of Asthma and Lung UK called the changes welcome but not the final step, pressing for further restrictions on packaging, flavours and displays still under government consideration.

What this means if you shop with us
For an adult customer who already buys from a retailer that takes age checks seriously, very little changes day to day, but a few things are worth knowing now these rules are in force. Expect to be asked for ID if there is any doubt about your age, for any product in our range, not only the ones that contain nicotine. Nicotine pouches and nicotine free vapes are no longer an exception, and that is a deliberate change rather than an oversight.
- No more free vapes, pouches or coupons as promotional giveaways, from any retailer, including us.
- Nominal price offers, such as a product listed at 10 pence to get around a promotion, are off the table everywhere.
- Ordinary discounting, seasonal sales and clearance of discontinued lines remain legal and are not affected by this change.
- Buying a vape, pod kit or pouch for someone under 18, even as a favour, is now its own offence.
If you want to browse responsibly, our full nicotine pouches range and our wider nicotine salt e-liquids are both sold under the same age checks described above, and our page on underage sales and how we prevent them sets out the policy behind every order we process.
Frequently asked questions
Is it true that nicotine free vapes and nicotine pouches now have an age limit in the UK?
Yes. From 29 October 2026, the legal age of sale of 18 applies to every vape and nicotine product sold in the UK, including nicotine free vapes, nicotine pouches, nicotine strips and nicotine pearls. Before this date, several of these products had no legal minimum age at all in England, Wales and Northern Ireland.
What happens if a shop sells a vape or nicotine pouch to someone under 18 now?
Trading standards in England, Wales and Scotland, or the local council in Northern Ireland, can issue a fixed penalty notice of 200 pounds in England, Wales and Scotland, or up to 250 pounds in Northern Ireland, as an alternative to prosecution. Repeated offences can lead to a restricted sale or premises order, or in Scotland a banning order, and a court can impose a much higher fine if the matter is prosecuted instead.
I am an adult. Can I still buy a vape or nicotine pouch for someone younger than me?
No. Proxy purchasing, buying or attempting to buy a vape or nicotine product on behalf of someone under 18, is now a separate offence in its own right across the UK, whatever the age of the adult doing the buying.
Can shops still offer discounts on vapes and e-liquids?
Ordinary discounting, seasonal sales, loyalty schemes and clearing discontinued stock are still allowed. What is now banned is giving vapes or nicotine products away free to promote them, or selling at a nominal price such as 10 pence specifically to achieve the same promotional effect.
Are vape vending machines banned everywhere in the UK now?
Yes, with one narrow exception. Vending machines that sell or dispense vapes or nicotine pouches are banned across the whole of the UK from 29 October 2026, except for vaping products supplied this way within adult inpatient areas of mental health hospitals in England and Wales.
What changes next after the 29 October rules?
From 1 January 2027, it becomes illegal to sell tobacco, herbal smoking products or cigarette papers to anyone born on or after 1 January 2009, alongside a digital duty stamp transition. A further ban on advertising and sponsorship of vaping and nicotine products is expected from 1 June 2027.
