UK Vape Discount and Free Sample Ban: What Changes From 29 October 2026

Free taster bottles, buy one get one free offers and steep discount codes have long been part of how vape shops win new customers. From 29 October 2026 several of these everyday promotional habits become a criminal offence under the Tobacco and Vapes Act 2026. Here is exactly what is banned, what retailers can still do, and why it is happening at the same time as the UK's new age verification rules.

Published 23 October 2026 Ecosmok Editorial Team

Most coverage of UK vaping law in 2026 has focused on duty, age checks and the disposable vape ban. A quieter change affects something every shopper has seen at least once: the free sample, the loyalty freebie or the deep discount code. From 29 October 2026, offering any of these on a vaping or nicotine product becomes an offence under the Tobacco and Vapes Act 2026, running alongside the UK wide age verification law and the nicotine pouches and zero nicotine vapes age restrictions already covered on this blog.

Why free samples and discounts are being restricted

Official guidance published on gov.uk on 11 August 2026, and updated the following day, set out the government's reasoning plainly: a free sample, a promotional giveaway or a price cut designed to pull in new customers can act as an incentive to try a nicotine product, including for people who would not otherwise buy one. The rule sits within the same Tobacco and Vapes Act 2026 that introduced the UK wide age verification and proxy purchasing offence and the nicotine pouches and zero nicotine vapes age law, both also taking effect on 29 October 2026, but it works through a different mechanism entirely. Age verification controls who can buy a product. This rule controls how it can be marketed once someone is old enough to buy it.

By the end of August, health bodies including Action on Smoking and Health, the Chartered Trading Standards Institute and the devolved nations' own health organisations had issued a joint call for retailers to prepare, and trade press coverage through October confirmed that vape shops, including online sellers, needed to review their promotional practices before the deadline.

What is banned from 29 October 2026

From 29 October 2026, it becomes an offence for anyone to give away a vaping or nicotine product, or a coupon for one, to a member of the public where the purpose or effect is to promote vaping or nicotine products. Free samples and promotional giveaways are specifically covered, as are free gifts given alongside a paid order. The same test applies to pricing: selling a vaping or nicotine product, or a coupon for one, at a substantial discount is also an offence where it has a promotional purpose or effect. Official guidance defines a substantial discount as a price reduction that significantly lowers the cost of a product compared with its standard selling price, and warns that selling at a nominal sum, such as 10p, would likely count as an offence.

The rules cover vape devices, e-liquid, coils, pods, and nicotine pouches, strips and pearls, and apply to every type of nicotine, including synthetic nicotine produced in a laboratory. They also catch branded items that are not vaping products themselves, such as a charger or lanyard carrying vape branding, if giving it away would promote a vaping or nicotine product. Components sold on their own, such as batteries, chargers and electrical leads, along with medical devices and medicines, fall outside the scope of the new offence. The restrictions apply right across England, Wales, Scotland and Northern Ireland, though penalties differ slightly by nation.

What is banned versus what is still allowed

Not every price change or promotion is affected. The table below sets out how the rule actually applies, including why our own Discount and Bulk Offers collections remain unaffected.

Practice Status from 29 October 2026 Why
Free sample bottles or try before you buy testers Banned Counts as a free vaping or nicotine product given away for a promotional purpose
A free gift or extra pod kit bundled with an order Banned Treated as a giveaway with a promotional purpose or effect
A flash sale or code that significantly lowers the standard price Banned if promotional Classed as a substantial discount under the new offence
Clearing older stock at a reduced price Still allowed Normal discounting to sell unsold stock is excluded from the rule
Bulk or trade discounts Still allowed Explicitly excluded from the new offence
A free vape through an NHS or council stop smoking service Still allowed Covered by a separate defence for schemes arranged by a public authority

Penalties for breaking the new rules

Breaching the free distribution or substantial discount offence can lead to a fixed penalty notice of £200 in England, Wales and Scotland, or £250 in Northern Ireland, subject to Northern Ireland Assembly approval. More serious or repeated breaches can be prosecuted. In England and Wales, a summary conviction carries up to 12 months in prison, an unlimited fine, or both, while conviction on indictment can bring an unlimited fine or up to two years in prison, or both. Scotland's summary conviction penalty is a fine of up to £10,000 or up to 12 months in prison, or both, and Northern Ireland's is up to six months in prison or a fine, or both. Persistent offenders can also face restricted sales orders, premises orders, or in Scotland, banning orders.

What this means for shoppers and retailers

None of this stops adult smokers from buying vaping products or finding a fair price. It simply removes the free sample, the loyalty freebie and the deep promotional discount as marketing tools.

  • Do not expect a free taster bottle or a surprise freebie added to your order after 29 October, even from a retailer you have bought from before.
  • Standard pricing, clearance sales and our Discount and Bulk Offers collections continue as normal, since clearing stock and bulk or trade pricing are not affected.
  • Retailers, EcoSmok included, are reviewing promotional wording and offers to stay compliant before the deadline.
  • This rule runs alongside, not instead of, the age verification and proxy purchasing offence and the nicotine pouches and zero nicotine vapes age law, both covered in detail in our earlier articles.
  • Our Age Verification page explains how we check every order is going to an adult, and our UK Laws & Regulations page rounds up the wider legal picture.

Frequently asked questions

What exactly is banned for vape shops from 29 October 2026?

From 29 October 2026 it becomes an offence to give away any vaping or nicotine product, or a coupon for one, to a member of the public where the purpose or effect is to promote vaping or nicotine products. It also becomes an offence to sell a vaping or nicotine product, or a coupon for one, at a substantial discount for the same promotional reason. This covers free samples, promotional giveaways and free gifts tied to a purchase.

Can I still use a discount code on vaping products after 29 October 2026?

Normal discounting is not affected. Retailers can still sell unsold stock at a reduced price as part of normal business, and bulk or trade discounts may still apply. What changes is a promotional discount that significantly lowers the price specifically to encourage more people to take up or buy more vaping or nicotine products.

Will this affect free vapes from NHS or council stop smoking schemes?

No. The new rules do not prevent a stop smoking service providing a vaping product, nicotine product or coupon where this is arranged by a public authority such as the NHS or a local council, including schemes like Swap to Stop.

What happens if a retailer breaks the new rules?

A retailer can receive a fixed penalty notice of £200 in England, Wales and Scotland, or £250 in Northern Ireland, subject to Assembly approval. More serious or repeated breaches can lead to prosecution, with maximum penalties in England and Wales of up to two years in prison on indictment, and persistent offenders can face restricted sales or premises orders.

Does this rule apply to online retailers as well as physical vape shops?

Yes. The restrictions on free distribution and substantial discounts apply across England, Wales, Scotland and Northern Ireland and cover online sellers in the same way as physical shops.

Why has the government banned free vape samples and steep discounts?

The restriction sits within the Tobacco and Vapes Act 2026, alongside the UK wide age verification rules and the nicotine pouches and zero nicotine vapes age law, both also taking effect on 29 October 2026. The aim is to stop promotional pricing and giveaways acting as an incentive for people, particularly those who do not already smoke, to take up vaping or nicotine products.
