Cllr Dr Wendy Taylor MBE, Chair of the LGA's Health and Wellbeing Committee, put it plainly: "The change on 29 October is the one people are overlooking. Nicotine pouches and zero nicotine vapes come under an age of sale of 18 for the first time." The briefing noted that plenty of shops still sell these products without asking for identification, simply because nobody has ever had to before. Neither product contains tobacco or produces vapour, so both sat outside the rules written for cigarettes and e-cigarettes. Scotland closed that gap some time ago; England, Wales and Northern Ireland catch up on 29 October 2026.

Government guidance on selling vaping and nicotine products, updated 11 August 2026, sets out the new scope in plain terms: "it will be an offence for retailers, including online retailers, to sell any vaping product or nicotine product to anyone under the age of 18." The guidance defines nicotine products broadly, covering "nicotine pouches (tobacco free pouches containing nicotine powder that are placed between the gum and lip), nicotine strips (dissolvable films containing nicotine that are placed on the tongue or between the gum and lip)" and "nicotine pearls (small dissolvable balls containing nicotine that dissolve under the tongue)", reaching every source of nicotine, including synthetic nicotine made in a lab, whatever the product looks like.

Three related rules travel with the age of sale change. Proxy purchasing becomes an offence, so an adult cannot legally buy any of these products for someone under 18. Free samples designed to promote them are banned, and selling at a substantial discount to promote a nicotine or vaping product is restricted too.

A nicotine pouch is a small, tobacco free pouch containing nicotine powder, flavouring and a plant based filler, placed between the gum and the lip rather than smoked or vaped. Nicotine strips and nicotine pearls work the same way, dissolving on the tongue or gum instead. A zero nicotine, or 0mg, vape sits at the other end of the same gap, delivering no nicotine at all, so the rules written around nicotine containing e-cigarettes in England, Wales and Northern Ireland never applied to it. Scotland closed that gap for 0mg vapes some time ago, and from 29 October 2026 the other three nations align, with a nicotine pouch and a 0mg vape both needing the same age check as a nicotine containing vape does today.

Reported industry commentary around the Tobacco and Vapes Act points to a further step still to come, a nicotine strength limit for pouches often cited around 20mg, well below the 100mg or higher strengths seen in some illicit products. That limit is not yet confirmed as in force. The change confirmed for 29 October 2026 is the age of sale rule, and that is the one to be ready for now.

Selling a nicotine pouch or a zero nicotine vape to someone under 18 after 29 October 2026 carries the same consequence as selling a nicotine containing vape to a minor does today: trading standards can issue a fixed penalty notice, reported at £200 in England, Scotland and Wales and up to £250 in Northern Ireland, with a reduction for early payment. John Herriman, Chief Executive of the Chartered Trading Standards Institute, put it plainly in ASH's 1 September 2026 press release: "Responsible retailers play a vital role in protecting children and supporting fair trading." ASH's Chief Executive, Hazel Cheeseman, added that "these are the first of a series of changes to the way tobacco and nicotine products are sold."

• Expect the same age check for a nicotine pouch, strip, pearl or zero nicotine vape from 29 October 2026 as you would buying a nicotine containing product today.
• A proxy purchase, buying any of these products for someone under 18, becomes an offence in its own right.
