EcoSmok has covered the age verification offence, the new nicotine pouches and zero nicotine vapes age law, and the free sample and discount ban separately as each was announced. With 29 October 2026 only days away, it is worth setting the three side by side, since they commence together and the question most readers actually have is simpler than any single explainer: what changes this week, and what happens if a seller breaks the rules.
Why three rules land on the same day
The Tobacco and Vapes Act 2026 received Royal Assent on 29 April 2026. Its provisions have been phased in through secondary legislation and guidance across the year, following the vaping products duty and duty stamps scheme on 1 October 2026. Government guidance confirming the detail of this next phase was published on 11 August 2026, and ASH, ASH Wales, ASH Northern Ireland and the Chartered Trading Standards Institute issued a joint reminder to retailers on 1 September 2026. The generational tobacco sale restriction, for anyone born on or after 1 January 2009, is still to follow on 1 January 2027.
John Herriman, Chief Executive of the Chartered Trading Standards Institute, said most responsible retailers already run strong age verification, so the new rules build on systems already in place, with trading standards offering advice and proportionate enforcement rather than treating every retailer as a deliberate lawbreaker.
Rule one: age verification and proxy purchasing
From 29 October 2026, a strengthened UK wide offence covers buying, or attempting to buy, a vaping or nicotine product on behalf of someone under 18, known as proxy purchasing. Retailers must be satisfied a customer is 18 or over before completing a sale and may ask for ID. In Scotland, retailers must operate a formal age verification policy, extended from 29 October 2026 to nicotine products as well as vapes. We covered the full detail, including why shops remain the most common source young people report, in our earlier article on the age verification law.
Rule two: nicotine pouches and zero nicotine vapes
The minimum age of sale of 18 is extended to cover products that previously sat in a grey area. In England, Wales and Northern Ireland, the old rule only applied to nicotine vapes, so zero nicotine vapes are newly covered alongside nicotine pouches, strips, pearls and synthetic nicotine products. Scotland already restricted both nicotine and non nicotine vapes and extends that same approach to nicotine products from the same date. Our dedicated article on nicotine pouches and zero nicotine vapes covers the background in full.
Juicy Peach Hayati Pro Max E-Liquid, No Nicotine
A good example of rule two in practice. This 100ml Hayati Pro Max e-liquid contains no nicotine at all, yet from 29 October 2026 it sits firmly inside the new minimum age of sale alongside every nicotine product we sell. We check every customer's age at checkout regardless of nicotine strength, including on zero nicotine lines like this one.
Shop NowRule three: free samples and substantial discounts
Giving away any vaping or nicotine product, or a coupon for one, becomes an offence where the purpose or effect is promotional, covering free samples, giveaways and promoted branded items such as chargers. Selling at a nominal sum, such as 10 pence, would likely count too. Ordinary discounting is unaffected, including clearing unsold stock or bulk and trade pricing, which is why our own discount collection is unaffected. The full distinction is set out in our article on the discount and free sample ban.
What the fines actually are
Government guidance published on 11 August 2026 sets out fixed penalty notices and court penalties for each offence by nation. The figures below are the same across all three rules commencing on 29 October 2026, though the free distribution and substantial discount offence also carries a separate, more serious court penalty track.
| Offence | Fixed penalty notice | Court fine (summary conviction) |
|---|---|---|
| Age of sale (any vaping or nicotine product) | £200 in England, Wales and Scotland; £250 in Northern Ireland, subject to Assembly approval | Up to £2,500 in England, Wales and Scotland; up to £5,000 in Northern Ireland |
| Proxy purchasing | £200 in England, Wales and Scotland; £250 in Northern Ireland, subject to Assembly approval | Up to £2,500 in England and Wales; up to £5,000 in Scotland and Northern Ireland |
| Free distribution or substantial discount | £200 in England, Wales and Scotland; £250 in Northern Ireland, subject to Assembly approval | Up to 12 months in prison and/or an unlimited fine on indictment in England and Wales; a fine up to £10,000 and/or 12 months summarily in Scotland, up to 2 years on indictment; up to 6 months summarily in Northern Ireland, up to 2 years on indictment |
What to expect as a shopper this week
- Expect to be asked for ID more consistently, including on products not always checked closely before, such as zero nicotine e-liquids and nicotine pouches.
- Free samples and giveaway promotions will disappear from reputable retailers, online and in store. A genuinely good price is still allowed, so normal sale pricing and bulk deals are unaffected.
- Buying a vaping or nicotine product as an adult to hand to someone under 18 is proxy purchasing, carrying its own penalty separate from the retailer's own responsibility at the till.
- None of this makes vaping harder to access for the adults it is meant for, smokers looking for a less harmful alternative, or adult vapers maintaining a device they already own.
A short readiness checklist for retailers
Hazel Cheeseman, Chief Executive of ASH, has described this phase as the first of a series of changes to how tobacco and nicotine products are sold, aimed at a smokefree UK and reduced youth vaping while keeping lower risk nicotine products available to adults stopping smoking. Suzanne Cass, Chief Executive of ASH Wales, has said retailers are essential to that goal by applying the rules consistently and reporting illegal sales.
- Brief every member of staff on the extended age checks before 29 October 2026, particularly for zero nicotine e-liquids and nicotine pouches.
- Remove any remaining free sample stock, promotional giveaways or nominal sum pricing from shelves and online listings.
- Review discount or loyalty promotions to confirm each is a genuine reduction rather than a disguised giveaway.
- Keep records of age verification checks and know how to report suspected proxy purchasing to trading standards.
- EcoSmok verifies the age of every customer before completing a sale, as set out on our Age Verification page, and our Youth & Underage Concerns page covers the wider picture for parents and carers.

Frequently asked questions
What vape laws change in the UK on 29 October 2026?
Three rules under the Tobacco and Vapes Act 2026 take effect on 29 October 2026. A strengthened UK wide age verification and proxy purchasing offence applies to anyone buying a vaping or nicotine product on behalf of someone under 18. A new age law extends the minimum sale age of 18 to nicotine pouches, strips, pearls and zero nicotine vapes. A ban on free samples, giveaways and substantial discounts on vaping and nicotine products also begins, where the purpose or effect is promotional.
What is the fine for proxy purchasing a vape for someone under 18?
From 29 October 2026, proxy purchasing a vaping or nicotine product for someone under 18 can carry a fixed penalty notice of 200 pounds in England, Wales and Scotland, or 250 pounds in Northern Ireland, subject to Assembly approval. A court can instead impose a fine of up to 2,500 pounds in England and Wales, or up to 5,000 pounds in Scotland and Northern Ireland.
Can vape shops still offer discounts after 29 October 2026?
Yes. Normal discounting is unaffected, including reduced price unsold stock and bulk or trade discounts. What becomes an offence is giving away a vaping or nicotine product for free, or selling one at a nominal sum such as 10 pence, where the purpose or effect is to promote it.
Are zero nicotine vapes and nicotine pouches now age restricted in the UK?
Yes, from 29 October 2026. In England, Wales and Northern Ireland, the old rule only covered nicotine vapes, so zero nicotine vapes are newly in scope alongside nicotine pouches, strips, pearls and synthetic nicotine products. Scotland already restricted both nicotine and non nicotine vapes and extends its policy to nicotine products from the same date.
What happens if a retailer breaks the new vaping rules?
Enforcement authorities such as trading standards can issue a fixed penalty notice of 200 pounds in England, Wales and Scotland, or 250 pounds in Northern Ireland, subject to Assembly approval, for the age of sale, proxy purchasing, free distribution and substantial discount offences. More serious or repeated breaches can be prosecuted, with court fines and, for the free distribution and discount offence specifically, a possible prison sentence of up to 2 years on indictment.
Do I still need ID to buy a vape or e-liquid in the UK?
Yes, and the rules are getting stricter, not looser. Retailers must be satisfied a customer is 18 or over before selling any vaping or nicotine product, including zero nicotine e-liquids and nicotine pouches from 29 October 2026, and may ask for ID. EcoSmok verifies the age of every customer before completing a sale.
