From 29 October 2026, a new offence takes effect across England, Wales, Scotland and Northern Ireland covering the sale of vaping and nicotine products to anyone under 18, alongside a formal ban on proxy purchasing. What actually changes on 29 October 2026
The minimum age to buy vaping and nicotine products in the UK stays at 18. What changes is how that rule is enforced. Under new provisions in the Tobacco and Vapes Act 2026, it becomes a specific offence, applied consistently across the whole of the UK, for any retailer, including online retailers, to sell a vaping or nicotine product to someone under 18. This replaces a patchwork of separate national rules with one consolidated framework and a standard set of penalties, described in official gov.uk guidance on selling vaping and nicotine products.

- It applies to every sales channel, so an online order is treated the same way as a sale across a counter.
- It sits alongside the outright ban on vending machine sales of vaping and nicotine products, which takes effect on the same day, with a narrow exemption for adult mental health inpatient facilities in England and Wales.
ID checks and proxy purchasing
From 29 October 2026, retailers in England, Wales and Northern Ireland can rely on a legal defence if they can show they took all reasonable steps to avoid selling to someone under 18, with the specific verification steps set out in regulations. In Scotland, retailers must run an age verification policy in line with Scottish Government guidance, which names the approved forms of identification a customer can be asked to produce, and a defence applies where staff genuinely believed a customer was 18 or over having checked one of those approved documents.
In practice, expect to be asked for a passport, a photocard driving licence, or a recognised proof of age card whenever you order age restricted products, whether that is in person or online. Many UK retailers already apply a Challenge 25 style approach, asking for proof of age from anyone who appears to be under 25, well above the legal minimum, as an extra safeguard.
The Act also introduces a specific proxy purchasing offence. From 29 October 2026, it is illegal for anyone aged 18 or over to buy, or attempt to buy, a vaping or nicotine product on behalf of someone under 18. This closes a route that age verification at the till alone could never fully cover.
