Health and trading standards enforcement are devolved matters. So while the Tobacco and Vapes Act 2026 sets one UK wide framework for the headline measures, the age of sale, the advertising ban and the generational sales ban, the detail of how each measure is registered, policed and penalised is set separately by the UK Government for England, the Scottish Government, the Welsh Government and the Northern Ireland Executive.

The Local Government Association's guidance for councils on the Act confirms this pattern, noting that enforcement bodies and penalty structures differ by nation even where the underlying rule is the same. For a shopper ordering from a different part of the country, that means the same product can sit inside slightly different rules depending on where the sale happens.

Scotland already runs a Register of Tobacco and Vaping Product Retailers, a scheme with no direct equivalent in England, Wales or Northern Ireland. From 29 October 2026, that register extends to cover retailers of herbal smoking products and nicotine products too, not only tobacco and vapes as before, according to a joint statement issued on 13 August 2026 by the Chartered Trading Standards Institute and ASH Scotland urging retailers to prepare for this next phase.

The Scottish Government's own commencement regulations for the Act set out the transitional detail for how this expanded register takes effect. The practical upshot is that a retailer trading in Scotland needs to check its registration covers the full range of products it sells from 29 October 2026, even if it was already registered for tobacco and vaping products beforehand.

Wales largely mirrors England's approach. A written statement published on 17 September 2026 confirmed the Welsh Government's consent to new age verification defence regulations shared with England, noting "no policy divergence between the Welsh Government and the UK Government" on that measure. The clearest difference sits in signage: age of sale notices in Wales must carry Welsh language text alongside English, on top of the same minimum size and character height used elsewhere in the UK.

Northern Ireland diverges more in how breaches are penalised. Rather than the flat £200 fixed penalty used in England and Wales, official guidance on fixed penalty notices sets out a tiered structure for Northern Ireland: up to £500 for registration related offences and up to £250 for retail sale offences, each reduced by 25 per cent for early payment. Northern Ireland also falls outside the mental health hospital vending machine exemption available in England and Wales.
